Terms of Service

By using MegaBrain you agree to these terms. The service is in private beta — things may break, change, or go down. We're a small team, we move quickly, and we'll communicate clearly. If anything is unclear, email hi@themegabrain.com.

MegaBrain ("the service") is an AI-assisted content production tool for marketers and SMM agencies. Operated at themegabrain.com by an individual founder ("we", "us").

By signing up or using the service in any way, you ("you", "the user") agree to these terms.

• You must be at least 16 years old to create an account.
• You're responsible for the security of your sign-in credentials.
• One account per person or organization. You may not share login credentials across people who aren't members of your team in the same workspace.
• You may close your account anytime by emailing us. We delete account data within 14 days of the request.

You agree NOT to use the service to:

• Generate content that is illegal, hateful, harassing, discriminatory, sexually exploitative of minors, or encourages self-harm.
• Impersonate real people (politicians, public figures, individuals) without their consent.
• Generate misinformation, deepfakes, or content meant to deceive an audience about who produced it.
• Spam, scrape, reverse-engineer the service, or interfere with its operation.
• Use the service to violate a third party's rights, including copyright, trademark, or privacy.

We may suspend or terminate accounts that violate this section, with or without notice.

You retain all rights to the brand content you upload and to the drafts the service generates on your behalf. We don't claim ownership.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content only to operate the service for you. This license ends when you delete the content or close your account.

You're responsible for ensuring you have the rights to any content you upload (brand assets, sources, reference posts).

Drafts produced by the service are generated by AI based on your inputs. AI output is not guaranteed accurate, on- brand, or fit for any purpose — you're responsible for reviewing every draft before publishing it. The service exists to draft-and-let-you-review, not to auto-publish unreviewed AI output.

Where the service uses third-party AI providers (Anthropic, OpenAI, others), their content policies also apply to your prompts and uploads. We aim to surface policy errors clearly when they happen.

The service is free during private beta. Beta users get early-bird pricing when paid tiers open. We'll give you at least 30 days' notice before any tier you're on requires payment. Pricing details, when they exist, live on the landing page and the in-product billing view.

The service is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, or fit for any particular purpose. We don't warrant the accuracy of AI output.

You use the service at your own risk. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the extent permitted by law, our liability for any claim arising from your use of the service is limited to the amount you've paid us in the 12 months before the claim — and since the service is free during beta, that's zero. We're not liable for indirect, incidental, or consequential damages (lost profits, lost data, lost reputation).

This limitation doesn't apply where law forbids it (gross negligence, willful misconduct, statutory consumer rights you can't waive).

You agree to indemnify and hold us harmless from any claim by a third party arising from your content, your use of the service in violation of these terms, or your violation of a third party's rights.

You may close your account anytime. We may suspend or terminate accounts for material breach of these terms (especially the Acceptable Use section), or if we shut the service down (we'll give 60 days' notice and let you export your data if that happens).

We may update these terms when the service changes materially (new features, pricing, vendors). For significant changes affecting your rights, we'll email account holders at least 14 days before the change takes effect. Continued use after the effective date counts as acceptance.

These terms are governed by the laws of the jurisdiction where the operator is registered. Disputes will be resolved by good-faith discussion first; failing that, by the local courts of that jurisdiction. Nothing here removes your statutory consumer rights where they apply.
